Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before using the Strike Pad mobile application (the “App”) and related services (collectively, the “Service”) operated by Fighter Foundry, Inc. (“Fighter Foundry,” “we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

1. Relationship to Other Agreements

Your use of the App is also governed by:

• Our End User License Agreement (EULA)
• Our Privacy Policy

If there is a conflict, the EULA controls with respect to licensing and intellectual property, and the Privacy Policy controls with respect to data handling.

2. Eligibility

You must be at least:

• 13 years old to use the App
• 16 years old if you are located in the European Union (EU)

By using the Service, you represent that you meet these requirements.

3. Accounts

Some features may require account registration. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your credentials
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Service

Strike Pad records and displays training and performance data generated from sensor-equipped equipment, including punch force, frequency, and impact metrics.

You agree not to:

• Use the Service for unlawful or unsafe purposes
• Attempt to reverse engineer, tamper with, or interfere with the App or sensors
• Use the App in any manner that could damage, disable, or impair the Service

5. Demonstration and Training Disclaimer

Strike Pad is intended for training, performance tracking, and demonstration purposes only. The App does not provide medical, fitness, or safety advice, and performance metrics may vary.

You assume all risks associated with physical training activities.

6. Purchases and Subscriptions

If the App offers in-app purchases or subscriptions:

• Payments are processed through Apple’s App Store
• Pricing, billing cycles, renewals, cancellations, and refunds are governed by Apple’s App Store terms
• Fighter Foundry does not process or store payment information

7. Communications

By creating an account, you may receive service-related communications. You may opt out of marketing communications at any time by following the unsubscribe instructions provided.

8. Intellectual Property

The App, including all software, design, trademarks, logos, and content (excluding user-generated content), is owned by Fighter Foundry, Inc. and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works without prior written consent.

9. User Content

If you submit feedback, suggestions, or other content:

• You retain ownership of your content
• You grant Fighter Foundry a non-exclusive, royalty-free license to use it to improve the Service

10. Third-Party Services

The App may link to or integrate with third-party services. We are not responsible for third-party content, policies, or practices.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for operational or security reasons.

You may stop using the App at any time by deleting it from your device.

12. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including fitness for a particular purpose or accuracy of performance data.

13. Limitation of Liability

To the maximum extent permitted by law, Fighter Foundry shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or training results.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Fighter Foundry, Inc., its officers, directors, employees, and partners from any claims arising out of your use of the Service or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

16. EU Consumer Rights

Nothing in these Terms limits mandatory consumer rights under applicable EU laws.

17. Apple App Store Disclaimer

This App is licensed to you by Fighter Foundry, Inc., not Apple.

Apple is not responsible for the App, its content, maintenance, or support, and has no warranty obligations related to the App.

Any claims relating to the App must be directed to Fighter Foundry, Inc., not Apple.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.
