END USER LICENSE AGREEMENT
(EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Fighter Foundry, Inc. (“Fighter Foundry,” “we,” “us,” or “our”) governing your use of the Strike Pad mobile application (the “App”), including any updates, firmware, data, and associated services (collectively, the “Services”).

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with this Agreement, Fighter Foundry grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on a mobile device you own or control
• Use the App solely for your personal, non-commercial use

2. Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble any portion of the App
• Rent, lease, lend, sell, sublicense, or distribute the App
• Circumvent or disable any security features
• Use the App in violation of any laws or to harm, harass, or infringe the rights of others

3. Account Registration

Certain features may require registration. You agree to:

• Provide accurate information
• Keep your account credentials secure
• Accept responsibility for all activity under your account

4. Data Collection and Use

The App collects and processes performance data (such as force, frequency, and impact location) to display and analyze your performance.

Use of the App is also subject to our Privacy Policy.

5. Ownership

The App and all related intellectual property are owned by Fighter Foundry, Inc. You receive no ownership rights under this Agreement.

6. Updates

We may provide updates or modifications to improve performance, fix bugs, or add new features. Updates may be installed automatically.

7. Termination

We may suspend or terminate your license if you violate this Agreement. Upon termination, you must cease all use and delete the App.

8. Disclaimer of Warranties

The App and Services are provided “AS IS” without warranties of any kind, express or implied. Fighter Foundry does not guarantee accuracy of recorded performance data.

9. Limitation of Liability

To the fullest extent permitted by law, Fighter Foundry shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data.

10. Indemnification

You agree to indemnify and hold Fighter Foundry, Inc. harmless from any claims, damages, or liabilities arising out of your use of the App or violation of this Agreement.

11. Governing Law

This Agreement is governed by the laws of the State of Delaware, without regard to its conflict of law principles.

12. Consumer Rights in the EU

Nothing in this Agreement limits any rights you may have under mandatory consumer-protection laws of your country of residence within the European Union.

If you are a resident of the EU, you may have additional rights under EU law that supersede portions of this Agreement in the event of a conflict.
